# Opalinx Noncommercial Licence 1.0

Copyright © 2026 Jean-Philippe Cô. All rights reserved except as expressly granted below.

By exercising any permission granted by this licence, you accept its terms.

## 1. Scope

This licence applies to the Opalinx materials distributed with it, including specifications,
documentation, conformance data, software, and artwork (the **Materials**). It does not apply to
third-party material identified as being under separate terms.

The **Opalinx Marks** are the Opalinx name, logo, certification marks, badges, and related branding.

## 2. Free noncommercial use

Subject to this licence, the licensor grants you a worldwide, non-exclusive, royalty-free copyright
licence to use, reproduce, modify, and distribute the Materials solely for noncommercial purposes.
The licensor also grants, solely for those purposes, a licence under any patent claims the licensor
can license that are necessarily infringed by using the Materials.

Noncommercial purposes include personal projects, education, academic or public-interest research,
evaluation, and testing without an intended commercial application. A business may evaluate and test
Opalinx internally, but production use supporting commercial activity is not noncommercial use.

Creating or publishing reviews, tutorials, commentary, news, or other editorial content about
Opalinx is permitted even when that content is monetized. This permission does not allow distribution
of the Materials beyond what this licence otherwise permits or imply certification or endorsement.

## 3. Commercial use

Commercial use requires a separate written commercial licence. Commercial use includes using the
Materials or an Opalinx implementation to develop, manufacture, market, provide, or support any
product or service that is sold, licensed, rented, subscription-funded, advertising-funded, or
otherwise intended for commercial advantage or monetary compensation. This includes hardware,
firmware, software, plugins, integrations, and hosted services.

An end user does not need a separate licence merely to use a product or service supplied by the
licensor or under a valid commercial licence, including in the end user's commercial activities.
This exception does not permit developing, manufacturing, distributing, or supplying a separate
Opalinx implementation.

This licence grants no permission for commercial use. To obtain a commercial licence, contact
Jean-Philippe Cô at <jp@djip.co>.

This licence governs only rights the licensor can grant. It does not restrict conduct for which
applicable law requires no permission from the licensor.

## 4. Distribution and modifications

Every copy or substantial portion of the Materials that you distribute must include this licence and
the copyright notice above. Modified Materials must be clearly identified as modified and must not be
presented as the authoritative Opalinx specification or as an official Opalinx release.

Recipients receive permissions directly from the licensor under this licence. You may not impose
terms that purport to replace or restrict those permissions for the Materials themselves.

By intentionally submitting a contribution to a repository or project published by the licensor,
you grant the licensor a perpetual, worldwide, irrevocable, royalty-free licence, with the right to
sublicense and relicense, to use, reproduce, modify, distribute, and license that contribution under
any terms. You represent that you have the authority to grant these rights and, to the extent
permitted by law, waive and agree not to assert moral rights in the contribution.

## 5. Name, logo, and certification

This licence permits limited use of the word **Opalinx** solely to identify the protocol or make a
truthful compatibility reference. Such use must not imply certification, endorsement, partnership,
or official status.

No permission is granted to use an Opalinx Mark as a product or service name, company name, domain
name, logo, certification mark, badge, or other branding. The Opalinx logo and the terms **Official
Opalinx** and **Opalinx Certified** require prior written permission. Compatibility does not itself
mean certification.

## 6. Termination

Your rights under this licence terminate automatically if you violate its terms. If this is your
first violation and you fully correct it within 30 days after receiving written notice, your rights
are reinstated retroactively. Otherwise, reinstatement requires written permission from the licensor.

Sections that by their nature should survive termination, including the commercial-use restriction,
trademark restrictions, warranty disclaimer, and limitation of liability, continue to apply.

## 7. No warranty; limitation of liability

To the maximum extent permitted by law, the Materials are provided **as is**, without warranties or
conditions of any kind, express or implied. The licensor will not be liable for any claim, damages,
or other liability arising from the Materials or their use, under any legal theory.

## 8. General

This licence does not waive fair use, fair dealing, or any other limitation or exception provided by
law. If any provision is unenforceable, the remaining provisions continue in effect. A failure to
enforce a provision is not a waiver. No rights are granted except as expressly stated.
