DIRECTOR'S REPORT

Case 24-OFD-001
This report is published pursuant to section 34(1) of the SIU Act.

The Incident
On April 12, 2024, the Subject Officer was on routine patrol in
Toronto, Ontario, when a 911 call reported a person in distress at
a residential address. The Complainant was a 28-year-old male.

Summary of the Incident
The Subject Officer responded to a call regarding a person in
crisis. Upon arrival, the Complainant was observed in possession of
a knife. Verbal de-escalation was attempted for approximately seven
minutes.

The Investigation
The SIU assigned three investigators to the case. Body-worn camera
footage from the Subject Officer was reviewed, along with witness
statements from the Complainant's family.

Narrative of Events
At approximately 14:23, the Complainant emerged from the residence
holding the knife. The Subject Officer issued multiple verbal
commands to drop the weapon. When the Complainant advanced toward
the Officer, a single round was discharged from the Officer's
service firearm.

Evidence
Body-worn camera, witness statements (n=3), forensic analysis of
the recovered firearm and knife, autopsy report.

Relevant Legislation
Section 25 of the Criminal Code provides legal authority for the
use of force by peace officers in the execution of their duties.

Analysis and Director's Decision
Having reviewed the totality of the evidence, I find that the
Subject Officer's use of force was reasonably necessary in the
circumstances.

Decision
I do not have reasonable grounds to believe that the Subject Officer
committed a criminal offence in connection with the death of the
Complainant. No charges will issue.
