# Opalinx Noncommercial Licence 1.0

Copyright © 2026 Jean-Philippe Cô. All rights reserved except as expressly granted below.

By exercising any permission granted by this licence, you accept its terms.

## 1. Scope

This licence applies to the Opalinx materials distributed with it, including specifications,
documentation, conformance data, software, and artwork (the **Materials**). It does not apply to
third-party material identified as being under separate terms.

The text of this licence is the **Licence Text** and is not part of the Materials.

The **Opalinx Marks** are the Opalinx name, logo, certification marks, badges, and related branding.

## 2. Free noncommercial use

Subject to this licence, the licensor grants you a worldwide, non-exclusive, royalty-free copyright
licence to use, reproduce, and distribute unmodified copies of the Materials solely for
noncommercial purposes. The licensor also permits you, solely for those purposes, to create and use
an independent implementation of the Opalinx protocol without modifying or incorporating the
Materials.

The licensor also grants, solely for noncommercial purposes, a licence under any patent claims the
licensor can license that are necessarily infringed by implementing or using the Opalinx protocol or
exercising the permissions granted by this licence.

Noncommercial purposes include personal projects, education, academic or public-interest research,
evaluation, and testing without an intended commercial application. A business may evaluate and test
Opalinx internally, but production use supporting commercial activity is not noncommercial use.

You may publish reviews, tutorials, commentary, news, and other editorial content about Opalinx,
including monetized editorial content, and may reproduce reasonable excerpts of the Materials for
that purpose. The excerpts must not substitute for the Materials or imply certification,
endorsement, or official status.

## 3. Commercial use

This licence grants no permission to use the Materials, or any patent claims licensed under this
licence, for commercial purposes. Commercial use includes using the Materials or an Opalinx
implementation to develop, manufacture, market, provide, or support any product or service that is
sold, licensed, rented, subscription-funded, advertising-funded, or otherwise intended for
commercial advantage or monetary compensation. This includes hardware, firmware, software, plugins,
integrations, and hosted services.

An end user does not need a separate licence merely to use a product or service supplied by the
licensor or under a valid commercial licence, including in the end user's commercial activities.
This exception does not permit developing, manufacturing, distributing, or supplying a separate
Opalinx implementation.

To the extent a commercial implementation requires permission under rights controlled by the
licensor, it requires a separate written commercial licence. To obtain one, send a message to
<licence@djip.co>.

This licence governs only rights the licensor can grant. It does not restrict conduct for which
applicable law requires no permission from the licensor.

## 4. Distribution and contributions

Every complete or substantial copy of the Materials that you distribute must preserve their
substantive content and include the Licence Text and the copyright notice above. This licence grants
no permission to distribute versions of the Materials with altered substantive content.

Technical changes necessary to store, transmit, package, build, or display the Materials are
permitted if they do not alter their substantive content. Such changes do not create modified
Materials for purposes of this licence. Compiling unmodified source code does not by itself create
modified Materials.

You may reproduce and distribute the Licence Text only verbatim and only with Materials to which the
licensor has applied it. This licence grants no permission to modify the Licence Text or distribute a
modified version of it.

Recipients receive permissions directly from the licensor under this licence. You may not impose
terms that purport to replace or restrict those permissions for the Materials themselves.

You may create and publish a fork, branch, patch, or pull request containing proposed modifications
solely for submission to and review by the licensor through a contribution process designated by the
licensor. You may not distribute the modified Materials for any other purpose.

By intentionally submitting such a contribution, you grant the licensor a perpetual, worldwide,
irrevocable, royalty-free licence, with the right to sublicense and relicense, to use, reproduce,
modify, distribute, and license that contribution under any terms. You represent that you have the
authority to grant these rights and, to the extent permitted by law, waive and agree not to assert
moral rights in the contribution.

## 5. Name, logo, and certification

This licence permits limited use of the word **Opalinx** solely to identify the protocol or make a
truthful compatibility reference. Such use must not imply certification, endorsement, partnership,
or official status.

No permission is granted to use an Opalinx Mark as a product or service name, company name, domain
name, logo, certification mark, badge, or other branding. The Opalinx logo and the terms **Official
Opalinx** and **Opalinx Certified** require prior written permission. Compatibility does not itself
mean certification.

## 6. Termination

Your rights under this licence terminate automatically if you violate its terms. If this is your
first violation and you fully correct it within 30 days after receiving written notice, your rights
are reinstated retroactively. Otherwise, reinstatement requires written permission from the licensor.

Termination does not affect accrued claims. The provisions concerning contributions, marks,
disclaimers, limitations of liability, and general interpretation survive termination.

## 7. No warranty; limitation of liability

To the maximum extent permitted by law, the Materials are provided **as is**, without warranties or
conditions of any kind, express or implied. The licensor will not be liable for any claim, damages,
or other liability arising from the Materials or their use, under any legal theory.

## 8. General

This licence does not waive fair use, fair dealing, or any other limitation or exception provided by
law. If any provision is unenforceable, the remaining provisions continue in effect. A failure to
enforce a provision is not a waiver. No rights are granted except as expressly stated.
